Purpose: Explore public attitudes towards the trade-offs between justice and medical outcome inherent in organ allocation decisions.Background: The US Task Force on Organ Transplantation recommended that considerations of justice, autonomy and medical outcome be part of all organ allocation decisions. Justice in this context may be modeled as a function of three types of need, related to age, clinical urgency, and quality of life.Methods: A web-based survey was conducted in which respondents were asked to choose between two hypothetical patients who (...) differed in clinical urgency , age, pretransplant and post-transplant quality of life, and life expectancy.Results: A pool of 1600 people were notified via email about the survey; 623 responded. Respondents preferred giving organs to younger people up to an age difference of <15.4 years and more clinically urgent people up to a difference in urgency of <2.54 months . Priority varied with the quality of life of the worst-off patient and the relative status of the patients. If both had worse than average quality of life, respondents preferred the better-off patient. When both had better than average quality of life, they preferred the worse-off patient. In analysis according to age versus clinical urgency, the older the patient, the more urgency needed to receive priority. In quality of life versus clinical urgency, the better the control’s quality of life, the more urgency the competing patient required. The worse the patient’s post-transplant outcome, the more urgency needed to receive priority.Conclusions: It appears that clinical urgency is only one of many factors influencing attitudes about allocation decisions and that respondents may invoke different principles of fairness depending the relative clinical status of patients. The role of power in healthcare can raise many ethical challenges. Power is ownership, whether given, ceded, or taken of another person’s autonomy. When a person has power over someone else, they can control or strongly influence the decision-making freedom of that person. From the principalist perspective1,2 of healthcare ethics, denying a person their freedom to choose, should only occur when justifying conditions related to beneficence and nonmaleficence are sufficiently satisfied. What drives Chinese MNEs’ global CSR integration and local CSR responsiveness? Drawing on institutional theory, we argue that both antecedents reflecting globally isomorphic patterns of adaptation and antecedents mirroring the distinct characteristics of China’s institutional context are relevant. We support our argument using fuzzy-set qualitative comparative analysis on a sample of 29 of China’s globally most influential companies. We find that state influence and global CSR associations affect global CSR integration, whereas presence in the West and internationalization through mergers and (...) acquisitions predict local CSR responsiveness. Our study thus suggests that home-country characteristics are an important co-determinant of the CSR approaches of emerging-market MNEs. We further find that multicultural experience in top management teams is associated with both global CSR integration and local CSR responsiveness, supporting notions of transnational CSR. (shrink)

A content analysis of Time magazine reporting on computers and related technologies over a ten-year period revealed that 36 percent of all these stories used explicitly magical or religious language. Deep brain stimulation (DBS), a surgical procedure involving the implantation of electrodes in the brain, has rekindled the medical community’s interest in psychosurgery. Whereas many researchers argue DBS is substantially different from psychosurgery, we argue psychiatric DBS—though a much more precise and refined treatment than its predecessors—is nevertheless a form of psychosurgery, which raises both old and new ethical and legal concerns that have not been given proper attention. Learning from the ethical and regulatory failures of older forms of psychosurgery (...) can help shed light on how to address the regulatory gaps that exist currently in DBS research. To show why it is important to address the current regulatory gaps within psychiatric DBS, we draw on the motivations underlying the regulation of earlier forms of psychosurgery in the US. We begin by providing a brief history of psychosurgery and electrical brain stimulation in the US. Against this backdrop, we introduce psychiatric DBS, exploring current research and ongoing clinical trials. We then draw out the ethical and regulatory similarities between earlier forms of psychosurgery and psychiatric DBS. As we will show, the factors that motivated strict regulation of earlier psychosurgical procedures mirror concerns with psychiatric DBS today. We offer three recommendations for psychiatric DBS regulation, which echo earlier motivations for regulating psychosurgery, along with new considerations that reflect the novel technologies used in DBS. In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment to both (...) distributive and recognitive justice. The disability rights movement's demand “Nothing about us, without us” requires substantive inclusion of disabled people in decision‐making related to their interests, including in crisis planning before, during, and after a pandemic like Covid‐19. The article analyzes Fichte's statements on the aesthetic discussion of his time and the conception of culture he developed as a mediator between the empirical and transcendental ego up to the inclusion of his theorems in the Jena early romantic period.

The essay deals with the question whether Fichte’s socio-economic model was a utopia, which missed the contemporary economic theories of Western Europe and neglected its historical realities, or whether Fichte developed socio-political guidelines based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen (...) in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? Finally, the author criticizes a superficial „up-dating“ of Fichte’s theoretical or political-economical ideas, because this would presuppose a horizon of problems which emerged only later. What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other. Im Zentrum des Beitrags steht die Problemstellung: Ist Fichtes sozialökonomisches Modell eine sowohl an den entwickelten zeitgenössischen ökonomischen Lehren Westeuropas vorbeigehende und historische Realitäten missachtende geschichtsferne Utopie? Oder entwickelte Fichte ein sowohl erfahrungsbasiertes wie auch zeitgenössische Ideen aufnehmendes sozialpolitisches Handlungskonzept? Weiterhin wird untersucht, wie sich seine sozialökonomischen Theoreme von kameralistischen und feudal-konservativen Erörterungen unterscheiden und inwieweit die These einer bereits kapitalismuskritischen Position Fichtes haltbar ist. Purpose– The purpose of this paper is to provide a response to Christiansen's paper, Ellen Christiansen “From ‘ethics of the eye’ to ‘ethics of the hand’ by collaborative prototyping”,Journal of Information, Communication and Ethics in Society, Vol. 12 No. 1.Design/methodology/approach– Reflection and critique of Christiansen's position.Findings– The paper raises questions about the conceptual basis, the realisation of participation and the conditions required for participative practice to be more broadly employed.Originality/value– It is an original response.

Critical theories often express scepticism towards the idea that social critique should draw on general normative principles, seeing such principles as bound to dominant conceptual frameworks. However, even the models of immanent critique developed in the Frankfurt School tradition seem to privilege principles over particular moral experiences. Discussing the place that particular moral experience has in the models of Honneth, Ferrara and Adorno, the article argues that experience can play an important negative role even for a critical theory that is (...) committed to the necessity of conceptual mediation, as moral experiences can undermine our confidence in the appropriateness of our moral concepts. Building on McDowell’s account of moral perception and Brandom’s interpretation of Hegel’s theory of experience, one can reconstruct Adorno as providing a “radically negativist” approach to immanent critique that takes particular moral experience seriously. Traditional arguments for privacy in public suggest that intentionally public activities, such as political speech, do not deserve privacy protection. In this article, I develop a new argument for the view that surveillance of intentionally public activities should be limited to protect the specific good that this context provides, namely democratic legitimacy. Combining insights from Helen Nissenbaum’s contextualism and Jürgen Habermas’s theory of the public sphere, I argue that strategic surveillance of the public sphere can undermine the capacity of citizens (...) to freely deliberate in public and therefore conflicts with democratic self-determination. For centuries, philosophers and theologians debated the meaning of monstrous births. This article describes the debates that took place in the early modern period concerning the origins of monstrous births and examines how they might be relevant to our understanding of disability today. I begin with the central questions that accompanied the birth of conjoined twins in the early 17th century as well as the theological origins of those questions. I then show the shifts that occurred in philosophical debate in (...) the 18th century, which reveal the changing understanding of God’s interaction with creation, as well as the burgeoning medical responses to monstrous births. By reexamining these earlier debates, I claim some of the earlier questions posed by philosophers and theologians have been neglected but remain relevant in bioethics debates concerning how best to consider and treat newborns with certain disabilities. This essay examines which contemporary scientific and philosophical problems led to the reference points for the resumption and reformation of diaresis. These multifaceted methodological and epistemological considerations form the contemporary background for Fichte's development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception crosses over the contemporary taxonomic approaches (...) and their spatially-static stratification of concepts as well as the approaches that shape hybridization with their latent temporalization of the conceptual chain. It forms a rupture in thinking related to the linking of species, in that the idea of the mediation of the species (of concepts) among themselves becomes the idea guiding the knowledge. Im vorliegenden Aufsatz wird untersucht, welche zeitgenössischen naturwissenschaftliche und philosophische Problemstellungen Anknüpfungs¬punk¬te zur Wiederaufnahme und Neuausformung der Diäresis führten. Diese vielgestaltigen methodologischen und erkenntnistheoretischen Überlegungen bilden den zeitgenössischen Hintergrund für Fichtes Ausbildung einer neuartigen analytisch-synthetischen Methode. Durch das Zugrundelegen einer Grundform, die in sich selbst die Möglichkeit zu einer differenzierenden Bildung enthält, wird die philosophische Begriffsentfaltung in ihrer Genese verfolgbar. This chapter discusses a fundamental ambivalence in Marx's use of the term "ideology". On the one hand, he employs a cognitivist critique of ideologies, condemning them in virtue of their epistemic or cognitive insufficiencies. On the other hand, what he so describes as false is a specific second-order belief: The belief that the cognitive is independent from material practice. If this belief is false, however, a merely epistemic critique of ideologies must miss its very point. -/- The chapter argues that (...) there is a way out of this dilemma if we assume, that ideologies are correct expressions of false practices. Ideological practices are practices which are constituted by norms that deny people the opportunity to legitimately question the categories which express basic distinctions established in the practices. In this case, ideological beliefs are not false, but deficient insofar they can only be expressed by employing concepts that rely on a limitation of our cognitive abilities. (shrink)

In this article, we explore questions about the culture of trustworthy artificial intelligence (AI) through the lens of ecosystems. We draw on the European Commission’s Guidelines for Trustworthy AI and its philosophical underpinnings. Based on the latter, the trustworthiness of an AI ecosystem can be conceived of as being grounded by both the so-called rational-choice and motivation-attributing accounts—i.e., trusting is rational because solution providers deliver expected services reliably, while trust also involves resigning control by attributing one’s motivation, and hence, goals, (...) onto another entity. Our research question is: What aspects contribute to a responsible AI ecosystem that can promote justifiable trustworthiness in a healthcare environment? We argue that especially within devising governance and support aspects of a medical AI ecosystem, considering the so-called motivation-attributing account of trust provides fruitful pointers. There can and should be specific ways and governance structures supporting and nurturing trustworthiness beyond mere reliability. After compiling a list of preliminary requirements for this, we describe the emergence of one particular medical AI ecosystem and assess its compliance with and future ways of improving its functioning as a responsible AI ecosystem that promotes trustworthiness. In the development of his analytical-synthetic method Fichte sought recourse to diaeresis, which reflects back methodically to Plato. While Plato indisputably provides the historical origin of diaeresis, very little is given as a direct reference for Fichte’s decision of terms. Therefore, the essay examines which contemporary scientific and philosophical problems led to the reference point for the resumption and reformation of diaeresis. It also shows how Fichte developed the diaeresis into a special transcendental philosophical method as well as tracking how it marks a turning point in philosophy. The multifaceted methodological and epistemological considerations for formulating the unity and diversity of appearances in nature and history form the contemporary background for Fichte’s development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception transcends the contemporary taxonomic approaches and their spatially-static stratification of concepts. This book uses insights from disability studies to understand in a deeper way the ethical implications that genetic technologies pose for Christian thought. Theologians have been debating genetic engineering for decades, but what has been missing from many theological debates is a deep concern for persons with genetic disabilities. In this ambitious and stimulating book, Devan Stahl argues that engagement with metaphysics and a theology of nature is crucial for Christians to evaluate both genetic science and the moral use (...) of genetic technologies, such as human genetic engineering, gene therapy, genetic screenings, preimplantation genetic diagnosis, and gene editing. Using theological notions of creation ex nihilo and natural law alongside insights from disability studies, the book seeks to recast the debate concerning genetic well-being. Following the work of Stanley Hauerwas, Stahl proposes the church as the locus for reimagining disability in a way that will significantly influence the debates concerning genetic therapies. Stahl's project in "genethics" proceeds with an acute awareness of her own liberal Protestant tradition's early embrace of the eugenics movement in the name of scientific and medical advancement, and it constructively engages the Catholic tradition's metaphysical approach to questions in bioethics to surpass limitations to Protestant thinking on natural law. Christianity has all too frequently been complicit in excluding, degrading, and marginalizing people with disabilities, but the new Christian metaphysics developed here by way of disability perspectives provides normative, theological guidance on the use of genetic technologies today. As Stahl shows in her study, only by heeding the voices of people with disabilities can Christians remain faithful to the call to find Christ in "the least of these" and from there draw close to God. It is known that in connection with proposed educational reforms in the German states around 1800, Johann Gottliebe Fichte, following the Enlightenment concepts, developed a program, which considered education as an indispensable human right. In this program, the idea of providing all the citizens with the opportunity to get an education has been formulated as a social task and a condition of social and political modernization. In accordance with Fichte’s thought, over the cultivation of individuals, a new morality, and then, (...) on that basis, a new civic subject had to shape itself. The science thenceforth should have obtained a function of organizing a new society, in Fichte’s vision of it, instead of theology having previously played that role, while the public education system should have mediated the application of the scientific principles of organizing the society and thus to become a driving force in this development process. The generally accessible education and science were conceived by Fichte as autonomous moments of social organization, being the area intact by any immediate influence of authorities and based on the principles of individuals’ free communication. Fichte’s theorem of intersubjectivity has introduced an understanding of teaching as a social and communicative process into the ethical and political, as well as into the educational thought. It was not limited to reproduction of predetermined skills by the subject, but took into account the subject’s formation in the course of actively perception of educational contents and the change of the subject himself taking place by that. Ableist attitudes and structures regarding disability are increasingly recognized across all sectors of healthcare delivery. After Dobbs, novel questions arose in the USA concerning how to protect reproductive autonomy while avoiding discrimination against and devaluation of disabled persons. As a case study, we examine the Louisiana’s Department of Public Health August 1st Emergency Declaration, “List of Conditions that shall deem an Unborn Child ‘Medically Futile.’” We raise a number of medical, ethical, and public health concerns that lead us to argue (...) the declaration should be rescinded. The ethically objectionable declaration provides valuable lessons concerning how to uphold both reproductive and disability justice in a post-Dobbs landscape. (shrink)

The problem of the social foundations of normativity can be illuminated by discussing the narrower question whether rule-following is necessarily a social matter. The problems with individualistic theories of rule-following seem to make such a conclusion unavoidable. Social theories of rule-following, however, seem to only push back one level the dilemma of having to choose either an infinite regress of interpretations or a collapse into non-normative descriptions. The most plausible of these models, Haugeland's conformism, can avoid these objections if it (...) is supplemented with an ontologically reasonable concept of the collective attitude of a group. Groups of individuals who are bound to shared norms by recognizing each other as equipped with a standard authority of criticism have the necessary properties for ascribing to those groups such collective attitudes. Lukács is widely recognized as being the first critical theorist to have explicitly developed the idea of a “standpoint theory”. According to such a theory, members of oppressed groups enjoy an epistemic privilege regarding the nature of their oppression. However, there is no agreement regarding what precise argument Lukács offers for his claims regarding the alleged epistemic privilege of the working class. Additionally, it remains unclear whether later feminist standpoint theories share any continuity with Lukács’s argument. In this analysis, I (...) identify four arguments for the epistemic privilege of oppressed groups that could be attributed to Lukács. I argue that, although Lukács does not consistently endorse any specific argument, the most promising interpretation suggests that epistemic privilege arises from a contradiction between the norms that guide the self-understanding of such groups and the effects of the social practices they are socially obligated to engage in. Women’s pain remains underappreciated, undertheorized, and undertreated in both medicine and theology. The ascetic practices of women in pain, however, can help Christians understand and navigate their own pain and suffering, particularly because they are experienced in the context of chronic illness and disability. In what follows, I argue that Christians would do better to view the pain that accompanies disability and chronic illness as a potential resource for spiritual practice rather than an example of sin or evil. I begin (...) with a brief overview of the most common theological explanations for the relationship between disability and sin within contemporary Christian writings on disability. What is often neglected in these conversations is the acknowledgment of pain in the disability experience. Likewise, discussions of evil often attempt to explain the existence of pain and suffering, but rarely address the practical realities of pain. As a way to begin to remedy the lack of attention to the experience of chronic pain for those living with illness and disability, I consider what it would mean to live faithfully with pain by examining the lives of three holy women who provide examples of what it means to interpret, manage, and share their pain within the body of Christ. In Morality and Socially Constructed Norms, Laura Valentini argues that moral obligations to respect social norms can be explained without invoking the concept of ‘joint commitment.’ Her resulting account is, in one important sense, individualistic, and therefore struggles to account for widely held intuitions about the normative significance of social norms. I argue that we can rescue the notion of joint commitment from Valentini’s objections, and incorporate it into a version of her account that preserves its insights.

In regard to the explanation of actions that are governed by institutional rules, John R. Searle introduces the notion of a mental “background” that is supposed to explain how persons can acquire the capacity of following such rules. I argue that Searle’s internalism about the mind and the resulting poverty of his conception of the background keep him from putting forward a convincing explanation of the normative features of institutional action. Drawing on competing conceptions of the background of Heidegger and (...) Wittgenstein, I propose to revise Searle’s conception. The background of institutional agency can only provide a convincing explanation if it includes the context of actions and intersubjective structures of a shared life-world. I suggest that a further development of this idea would lead to the identification of the background with a web of social recognition. (shrink)

Although the critique of reification is a core commitment of critical theories, there is no widely accepted account of its normative foundation. In Lukács’s original analysis, this foundation is provided by a strong concept of practice which is, however, not acceptable from a contemporary point of view. I argue that the systematic character of reification theory can only be upheld if this concept is replaced by a more intersubjective notion of normative practices. Reification can then be analysed as a second-order (...) pathology of social practices, as an inhibition of reflexivity by their normative shape. The normative justification of such critique, however, turns out to be more context-dependent than it is usually imagined. (shrink)

This article considers the question ‘What makes hope rational?’ We take Adrienne Martin’s recent incorporation analysis of hope as representative of a tradition that views the rationality of hope as a matter of instrumental reasons. Against this tradition, we argue that an important subset of hope, ‘fundamental hope’, is not governed by instrumental rationality. Rather, people have reason to endorse or reject such hope in virtue of the contribution of the relevant attitudes to the integrity of their practical identity, which (...) makes the relevant hope not instrumentally but intrinsically valuable. This argument also allows for a new analysis of the reasons people have to abandon hope and for a better understanding of non-fundamental, ‘prosaic’ hopes. (shrink)

This article offers reinterpretation of the current economic and political crisis through the lens of Gramsci’s concept of “interregnum,” departing from the model of “punctured equilibrium” to analyze the specific political dynamics of nonhegemonic periods between the breakdown of one ideological order and the emergence of a new one. Although political science has a range theories about periods of hegemony and paradigmatic stability, the periods between stable hegemonies remain distinctly undertheorized. A theoretical concept describing periods of interregnum is offered and (...) applied to the changes in economic ideology and political alignments that followed the breakdown of the liberal order in the interwar period and the postwar Keynesian consensus of the 1970s. The concept is then applied to the current juncture, in which the hegemony of neoliberalism has been shaken by the 2008 financial crisis but no clear successor has emerged. (shrink)

A new essay to analyse the demonstration which Aristotle gave of Barbara ACP is realized with the techniques of mathematicallogic. The critical points are indicated; based on them it is considered that Aristotle’s proof is not conclusive.

In this paper I will show how the medical image, presented to the patient by the physician, participates in medicine's cold culture of abstraction, objectification and mandated normativity. I begin by giving a brief account of the use of anatomical imaging since the Renaissance to show how images have historically functioned in contrast to how they are currently used in medical practice. Next, I examine how contemporary medical imaging techniques participate in a kind of knowledge production that objectifies the human (...) body. Finally, I elucidate how physicians ought to place the medical image within the context of the lived body so as to create a healing relationship with the patient. In all this I hope to show that the medical image, far from a piece of objective data, testifies to the interplay of particular beliefs, practices and doctrines contemporary medicine holds dear. To best treat her patient, the physician must appreciate the influence of these images and appropriately place them within the context of the patient's lived experience. (shrink)

Theories of ideology explain the stability of unjust social institutions by reference to the ways in which social power undermines the epistemic agency of those subordinated by them. The historically dominant model of ideology understands it as ‘false consciousness’, that is, as a set of socially distorted beliefs. The false consciousness model of ideology is, however, unsatisfactory in various respects. I argue that this, in part, explains why theorists have more recently turned to a competing model that understands the epistemic (...) constraints caused by relations of social power in terms of hermeneutical injustices. While Fricker’s theory of hermeneutical injustice avoids some implausible assumptions of false consciousness theories, it lacks, however, a plausible account of how social power can distort hermeneutical resources. I argue that there is a competing model of ideology in the Marxist tradition, according to which ideologies arise from distortions of concepts that are internal to social practices; this model takes up the insights from theories of hermeneutical injustices, and supplements them with a convincing ‘materialist’ explanation of how power, practices, and discourse are linked. Ethical issues of information and communication technologies (ICTs) are important because they can have significant effects on human liberty, happiness, and people’s ability to lead a good life. They are also of functional interest because they can determine whether technologies are used and whether their positive potential can unfold. For these reasons, policy makers are interested in finding out what these issues are and how they can be addressed. The best way of creating ICT policy that is sensitive to ethical (...) issues pertain to being proactive in addressing such issues at an early stage of the technology life cycle. The present paper uses this position as a starting point and discusses how knowledge of ethical aspects of emerging ICTs can be gained. It develops a methodology that goes beyond established futures methodologies to cater for the difficult nature of ethical issues. The capacity to designate a surrogate (CDS) is not simply another kind of medical decision-making capacity (DMC). A patient with DMC can express a preference, understand information relevant to that choice, appreciate the significance of that information for their clinical condition, and reason about their choice in light of their goals and values. In contrast, a patient can possess the CDS even if they cannot appreciate their condition or reason about the relative risks and benefits of their options. Patients who (...) lack DMC for many or most kinds of medical choices may nonetheless possess the CDS, particularly since the complex means-ends reasoning required by DMC is one of the first capacities to be lost in progressive cognitive diseases (eg, Alzheimer’s disease). That is, patients with significant cognitive decline or mental illness may still understand what a surrogate does, express a preference about a potential surrogate, and be able to provide some kind of justification for that selection. Moreover, there are many legitimate and relevant rationales for surrogate selection that are inconsistent with the reasoning criterion of DMC. Unfortunately, many patients are prevented from designating a surrogate if they are judged to lack DMC. When such patients possess the CDS, this practice is ethically wrong, legally dubious and imposes avoidable burdens on healthcare institutions. (shrink)

Educators continue to struggle with how masculinities are performed and regulated in spaces of learning. In a time of rapid social change, there is a renewed impetus for gender justice reform in schooling, though these approaches themselves remain a shifting picture. Adding a new layer of complexity, we are now witness to educational policy recommendations around surveillance which are designed to counteract boys’ and young men’s vulnerabilities to be radicalised into the misogynies of the ‘manosphere’. These recommendations exist despite limited (...) research and significant gaps in our understanding regarding both the manosphere as well as the emotional lives of young men. The article intentionally shifts the conversation from reactive surveillance in schools to educative gender justice approaches. We focus, in particular, on the significance of ‘pedagogic discomfort’ in terms of fostering gender transformative dialogue which is critical of ideas associated with the manosphere. We consider how a constructive dialogue might be fostered with a particular focus on pedagogies that recognise the emotional intensities of gender justice work. (shrink)

A new approach to environmental policy analysis is introduced that is designed to mitigate the exacerbation of environmental problems, which can result from the application of traditional approaches in environmental decision making. These approaches are problematic because they tend to rely on technical fixes, a single-discipline focus, and optimality. When such traditional approaches are applied, complex environmental problems are simplified beyond recognition, and the solution produced no longer matches the original problem. An alternative approach has been developed at the U.S. (...) Environmental Protection Agency (EPA) that is designed to improve the utilization of scientific research results and data (social, physical, and biological) through a more inclusive problem-solving process aimed particularly at difficult and complex environmental issues. Using a policy application pertaining to the EPA’s 1995 decision to approve a fuel additive, the authors illustrate how integrated environmental policy decision analysis can be made operational using this new approach. Rahel Jaeggi argues that forms of life ought to be the main reference point for a critical theory of society because the internal normative structure of life forms allows for immanent critique. In this article, I extend her model by systematically considering the possibility of oppressive forms of life. Oppressive forms of life are clusters of practices in which subordinated groups are systematically excluded or disabled from participating in the social processes of interpretation through which the values and purposes of (...) those very practices are determined. The possibility of oppressive forms of life poses a challenge to the method of immanent critique because it seems that any such critique must rely on immanent norms that are at least partly constituted by interpretations and that can therefore be distorted by oppression. I argue that Jaeggi’s model of immanent critique can be extended to respond to that challenge, either by recovering a constitutive form of freedom within all forms of life or by consciously adopting a partisan stance in favour of oppressed and marginalised self-understandings. The work of the Hungarian Marxist Georg Lukács is a constant source of controversy in the history of the Frankfurt School. All leading thinkers of that theoretical tradition have struggled with Lukács’s theory. On the one hand, it was an inspiration for their attempts to come to terms with the oppressive features of capitalist modernity. On the other hand, both its political conclusions and Lukács’s actual philosophical submission to Soviet orthodoxy seemed to show that his theoretical framework was deeply flawed (...) in one aspect or another. Wonder is not a sentimental or romantic feeling, but an intermingling of both admiration and fear. Wonder is perhaps closest to awe, which has connotations of both reverence and terror. Wonder holds together both the negative and positive emotions that awe once elicited. Finding wonder in your own body, therefore, can be both a fearful and exhilarating (...) experience, one that demands a kind of reconstitution of the self, since the body that was once taken for granted has now become alien. Basierend auf dem Gedanken der Einheit des Bewusstseins stellte sich die Aufgabe, die verschiedenen Erscheinungen in ihrem inneren Zusammenhang wie auch ihrer geschichtlichen Erscheinungsweise zu erklären. Hierzu erfuhr das transzendentale Subjekt eine tiefgreifende Historisierung durch den Versuch, eine Phänomenalogie des Geistes zu erarbeiten. Im Artikel wird weiterhin insbesondere das methodische Vorgehen Fichtes und dessen Dogmatismuskritik analysiert. For Fichte, too, the development of transcendental philosophy (...) was combined with the deepening of the historical tendency inherent in it. Based on the idea of the unity of consciousness, the task was to explain the various phenomena in their inner context as well as their historical appearance. To this end, the transcendental subject experienced a profound historicization through the attempt to develop a phenomenology of spirit. The article continues to analyze in particular Fichte's methodological approach and his criticism of dogmatism. И для Фихте развитие трансцендентальной философии сочеталось с углублением присущей ей исторической тенденции. На основе идеи единства сознания возникла задача объяснения различных явлений как в их внутреннем контексте, так и в их историческом облике. С этой целью трансцендентальный субъект претерпел глубокую историзацию посредством попытки разработать феноменологию духа. Para ello, el sujeto trascendental experimentó una profunda historización a través del intento de desarrollar una fenomenología del espíritu. This article suggests a new approach to understanding the self-formation of subjectivity in the work of Michel Foucault that emphasizes the influence of his mentor, the philosopher and historian of science Georges Canguilhem. I argue that Foucault adapts Canguilhem’s biological–epistemological notion of ‘error’ in order to achieve two things: to provide a notion of subjective self-formation compatible with the claims of his ‘archaeology of knowledge’ and ‘genealogy of power’, and to provide an alternative to the phenomenological theory of the subject. (...) The notion of ‘error’ accomplishes these goals because it posits that experience is the result of knowledge, not vice versa. To illustrate the notion of ‘erroneous’ subjectivity, I turn to two volumes edited by Foucault: I, Pierre Rivière, having slaughtered my mother, my sister and my brother… and Herculine Barbin; Being the Recently Discovered Memoirs of a Nineteenth- Century French Hermaphrodite. Both juxtapose ‘subjective’ accounts of ‘abnormal’ individuals with ‘objective’ documents written by judges, psychiatrists and medical professionals in order to show how ‘erroneous subjectivities’ may transgress epistemological limits and form new concepts. Scientifically derived environmental indicators are central to environmental decision analysis. This article examines the interface between science (environmental indicators) and policy, and the dilemma of their integration. In the past, science has been shown to dominate many policy debates, usually with unfavorable results. The issue, therefore, is not whether science can determine policy but how science can be part of a more holistic analysis that incorporates other critical perspectives. This article discusses the importance of considering alternative views (as represented by (...) different scientific indicators) within the policy debate. Six example ozone indicators, constructed from the same raw data, are used to illustrate this point. Two represent newly developed indicators that respond to present-day policy questions at theU.S. Environmental Protection Agency. The article concludes with a brief discussion of how such indicators can be used to better define a policy question, inform the policy debate, and evaluate policy alternatives. (shrink)

Significant challenges arise for clinical care teams when a patient or surrogate decision-maker hopes a miracle will occur. This article answers the question, “How should clinical bioethicists respond when a medical decision-maker uses the hope for a miracle to orient her medical decisions?” We argue the ethicist must first understand the complexity of the miracle-invocation. To this end, we provide a taxonomy of miracle-invocations that assist the ethicist in analyzing the invocator's conceptions of God, community, and self. After the ethicist (...) appreciates how these concepts influence the invocator's worldview, she can begin responding to this hope with specific practices. We discuss these practices in detail and offer concrete recommendations for a justified response to the hope for a miracle. (shrink)
